Terms of Service

1. Acceptance of Terms

By accessing and using Confetti ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Confetti provides AI-powered video generation services to create personalized birthday invitation videos. The Service allows you to generate custom video invitations for children's birthday parties using various themes and styles.

3. Payment Terms

Each personalized video invitation is subject to a fee as displayed at the time of purchase. Payment is processed through Stripe, a third-party payment processor. By using the Service, you agree to Stripe's Terms of Service and Privacy Policy.

You are responsible for providing accurate payment information. We are not responsible for payment processing errors or failures caused by Stripe or your financial institution.

Payments are generally final and non-refundable. However, if video generation fails due to a technical error on our part or our third-party AI service provider (fal.ai), we may, at our sole discretion, provide a refund or regenerate the video at no additional cost. Refunds are not available for user errors, content issues, or dissatisfaction with generated content quality.

4. User Content and Data

You are responsible for all content you provide, including names, dates, locations, and other information. You represent and warrant that you have the right to use any personal information you provide, including names of children and guests. You grant us a license to use this information solely to provide the Service.

5. Third-Party Services and Dependencies

The Service relies on third-party services to function, including but not limited to:

• fal.ai: AI-powered video generation service. Video generation is subject to fal.ai's availability, rate limits, and terms of service. We are not responsible for fal.ai service outages, failures, or limitations.
• Stripe: Payment processing. All payment transactions are subject to Stripe's terms and conditions. We are not responsible for Stripe service outages or payment processing failures.
• Google Places API: Address autocomplete functionality. Subject to Google's terms of service and API limitations.
• Supabase: Database and storage services. Data storage is subject to Supabase's terms and availability.

We do not guarantee the availability, reliability, or performance of any third-party service. Service interruptions, failures, or limitations caused by third-party providers are beyond our control, and we are not liable for any resulting damages or losses.

6. AI-Generated Content

Videos generated through the Service are created using artificial intelligence technology provided by fal.ai. You acknowledge and agree that:

• AI-generated content may contain errors, inconsistencies, or unexpected results
• We do not guarantee the accuracy, quality, appropriateness, or suitability of generated videos
• Generated videos are provided "as-is" without warranties of any kind
• AI generation may occasionally fail or produce unsatisfactory results, and we are not obligated to regenerate videos unless the failure is due to a technical error on our part
• You are responsible for reviewing generated content before sharing or using it
• We reserve the right to refuse to generate content that violates our policies or applicable laws

If video generation fails due to a technical error on our part or fal.ai's service, we will make reasonable efforts to regenerate the video or provide a refund at our discretion. However, we are not responsible for delays, quality issues, or failures caused by fal.ai's service limitations or your input.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, third-party service outages, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service unavailability, including delays in video generation or inability to complete orders.

8. Intellectual Property

The videos generated through the Service are provided for your personal, non-commercial use. You may not resell, redistribute, or use the videos for commercial purposes without our written permission. All technology, designs, and content underlying the Service remain our property. Generated videos may incorporate AI technology and models owned by third parties (including fal.ai), and your use is subject to their respective terms.

9. Prohibited Uses

You agree not to use the Service to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. You may not attempt to reverse engineer, copy, or misuse the Service. You may not use the Service in any way that violates the terms of service of our third-party providers (including fal.ai, Stripe, Google, or Supabase).

10. Data Sharing with Third Parties

To provide the Service, we share certain data with third-party service providers:

• Video generation requests, prompts, and images are sent to fal.ai for processing
• Payment information is processed by Stripe in accordance with their security standards
• Location data may be processed by Google Places API for address autocomplete
• User data and video metadata are stored in Supabase databases

By using the Service, you consent to this data sharing as necessary to provide the Service. We require third-party providers to maintain appropriate security measures, but we are not responsible for their data handling practices beyond our direct control.

11. Limitation of Liability

To the maximum extent permitted by law, Confetti shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits or revenues, whether incurred directly or indirectly
• Any loss of data, use, goodwill, or other intangible losses
• Failures, outages, or errors caused by third-party services (fal.ai, Stripe, Google, Supabase, etc.)
• Quality issues, errors, or unsatisfactory results in AI-generated content
• Delays in video generation or service delivery
• Losses resulting from your use or inability to use the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or a minimum amount as determined by applicable law, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Confetti and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your content, or your violation of any third-party rights.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
